A Federal High Court in Lagos has dismissed an attempt by the National Drug Enforcement Agency (NDLEA) to keep the popular Proxy Nightclub sealed. In a ruling delivered on Wednesday, Justice Lewis-Allagoa rejected the agency’s motion to halt the enforcement of an earlier court order that had directed the reopening of the business.
The legal battle stems from a high-profile midnight raid on October 26, 2025, where the NDLEA stormed the club and arrested over 100 people, including well-known Lagos socialite Mike Eze Nwalie Nwogu, famously known as Pretty Mike. While the agency moved to have the property forfeited on the grounds that it was being used for drug-related activities, the court had previously refused that request, citing the constitutional right to the presumption of innocence.
In the latest proceedings, Justice Lewis-Allagoa pointed out several “crucial lapses” in the NDLEA’s application. The judge noted that the agency sought to stop a ruling from December 5 but failed to address the foundational ruling made on November 28. The court also criticized the prosecution for what it described as “forum shopping” and an abuse of the court process, noting that the agency had been slow to even compile the necessary records for their appeal.
The judge was quite firm in his assessment, stating that the NDLEA failed to show any special or exceptional circumstances that would justify keeping the club shut while an appeal is pending. He described the agency’s motion as being filed in bad faith and lacking in merit. Furthermore, the court expressed concern over the agency’s delay, labeling their approach as “indolent” despite the case being designated for a fast-track appeal.
As it stands, the court has not only ordered the unsealing of the property but has also authorized a substituted service on the Chairman of the NDLEA, warning of the consequences of disobeying court orders. Justice Lewis-Allagoa urged the leadership of the agency to comply promptly with the law and respect the subsisting orders regarding Proxy Nightclub.
The substantive trial, where Pretty Mike and others will continue to defend themselves against drug-related charges, has been adjourned until February 9 and 10, 2026. This case continues to draw significant attention as it balances the powers of law enforcement against the property rights and legal protections of citizens.
