Ojukwu Transport Limited has expressed concern over the repeated disappearance of court records in its ongoing property dispute involving Bianca Ojukwu and her sons, while also confirming that it has filed a motion seeking a stay of execution pending the outcome of its appeal.
The matter, which came up before Justice A. M. Lawal of the Lagos High Court sitting in Ikeja on Monday, could not proceed after the court file was again unavailable. The case was subsequently adjourned after it was reported that the file had not been returned to the court.
This marks the second time in six weeks that proceedings have been stalled for the same reason. A similar situation occurred on May 8, 2026, when the case was also unable to continue because the court file could not be produced.
According to Ojukwu Transport Limited, the file was taken from the Ikeja Judicial Division to Lagos more than two months ago for the execution of a warrant but has yet to be returned.
The company also noted that the legal representatives of the claimants were absent from court on both occasions when the matter was scheduled for hearing.
Describing the repeated development as disturbing, Ojukwu Transport Limited said the continued absence of the court records has delayed the case and raised concerns about how such important documents are being handled.
Amid the delays, the company disclosed that it has filed and served a motion for stay of execution before the Court of Appeal. The application seeks to prevent the enforcement of the judgment until the appellate court delivers its decision on the appeal against the 2022 judgment in Suit No. LD/1539/2012.
The company maintained that the application became necessary because efforts were already being made to enforce the judgment despite the appeal still pending before the higher court.
It further argued that the properties at the centre of the dispute had earlier been affected by a warrant of execution arising from a separate judgment delivered in 2018 by Justice Adedayo Oyebanji in Suit No. LD/794/2011.
Following the latest development, the court adjourned the matter until October 8, 2026.
One of the directors of Ojukwu Transport Limited, Dr. P. Ike Ojukwu, was present in court on both adjourned dates on behalf of the company.
The company’s legal team is led by Ifeanyi Okumah and Chief O. Ugolo, SAN, while Bianca Ojukwu and her sons are represented by Nick Omeye and his firm.
