Court Dismisses ADA’s Suit Against INEC Over Legal Flaws

The Federal High Court sitting in Abuja on Wednesday struck out a legal challenge brought by the All Democratic Alliance against the Independent National Electoral Commission. In a decisive ruling, Justice Emeka Nwite dismissed the suit, pointing to fundamental procedural flaws that rendered the case incompetent and lacking in merit.

The core of the court’s decision centered on the specific way the political party chose to initiate the lawsuit. Justice Nwite observed that the ADA had used an originating summons to bring the matter forward, a choice he described as “hostile” given the nature of the claims. According to the judge, because the suit contained serious allegations of fraud and criminal activity, it could not be resolved solely through written statements or affidavit evidence.

Legal standards tracked by Zoyols News highlight that fraud allegations require a much higher level of scrutiny than a simple summary judgment allows. Justice Nwite explained that such claims must be initiated through a writ of summons. This particular legal path is necessary because it opens the door for a full trial, where witnesses can be called to testify in person and, more importantly, undergo cross-examination to test the truth of their claims.

By choosing the wrong procedural route, the judge noted that the ADA had effectively deprived the other defendants in the case of their right to a fair hearing. Without the ability to cross-examine those making the accusations, the court found it impossible to reach a just conclusion based on the documents provided. The judge emphasized that the mode of starting a lawsuit is a fundamental rule of law; when a case is filed improperly, it robs the court of the jurisdiction needed to hear it in the first place.

Concluding the session, Justice Nwite upheld the preliminary objections raised by the defense. He ruled that the most appropriate course of action was to set aside the entire proceedings, describing the effort as unmeritorious and officially dismissing the suit. This ruling serves as a significant reminder of the strict technical requirements governing election-related litigation in the country.
